These Terms of Service ("Terms") govern your use of SpeleoMap (the "App"), provided by Alpine First Day Cover LLC ("AFDC," "we," "us"). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Description of the Service

SpeleoMap is an iOS application that uses iPhone LiDAR, motion sensors, and cameras to record cave surveys. The App produces 3D scans, survey trajectories, station data, photos, and notes, and exports these to standard cave-survey formats. The App operates primarily on-device; data is transmitted off-device only in the narrow circumstances described in the Privacy Policy.

2. Subscription and Auto-Renewal

SpeleoMap is offered as an auto-renewing subscription on two plans: a monthly subscription for $4.99 per month and an annual subscription for $29.99 per year, billed through your Apple ID. Both plans provide full access to the App's subscription features. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. You may manage, change, or cancel your subscription at any time through your Apple ID account settings.

Payment is charged to your Apple ID at confirmation of purchase. If a renewal payment fails, Apple's standard billing grace period applies, during which access to the App may continue while payment is retried. If payment is not successfully completed within Apple's grace period, access to subscription features may be suspended.

Refunds, where applicable, are handled by Apple under the App Store's refund policy.

3. Cave Conservation

A portion of subscription proceeds may be allocated by AFDC, in its sole discretion, to cave conservation. Cave conservation may include, without limitation, cave gating and access projects, cave restoration and cleanup, conservation grants, and discretionary support of caving organizations and grottos. AFDC determines in its sole discretion whether, how, when, and to whom any conservation funds are applied.

During onboarding you may optionally indicate a grotto affiliation. A grotto selection is a non-binding preference that AFDC may consider when directing conservation funds. It does not obligate AFDC to make any payment to that grotto or to any other organization, it does not designate any portion of your subscription as a payment to any grotto, and it creates no right or beneficiary interest in any third party. Any grotto selection is recorded one time at onboarding and is not modified through the App afterward.

These allocations are discretionary and are not guaranteed. They are not refunds, donations from you, or charitable contributions made on your behalf. No portion of any subscription fee is held in trust or designated as a third-party donation. AFDC reserves the right to modify, suspend, or discontinue any conservation allocation or related program at any time and for any reason without notice.

4. License

Subject to your compliance with these Terms and your active subscription, AFDC grants you a limited, non-exclusive, non-transferable, revocable license to install and use SpeleoMap on a personal iPhone for your personal, non-commercial cave surveying activities.

5. Your Data and Content

All cave maps, scans, photos, notes, survey data, and other content you create using SpeleoMap belong to you. SpeleoMap stores this content locally on your device. AFDC does not collect, transmit, or claim ownership over any cave-survey content you produce.

6. Acceptable Use

You agree not to:

Use the App in violation of any law or regulation, including cave-access restrictions, land-use rules, or the protection of cultural or environmental resources
Use the App in violation of the Apple App Store Terms of Service, Apple Media Services Terms and Conditions, or any other applicable Apple terms, policies, or developer guidelines
Reverse engineer, decompile, or attempt to extract the source code of the App
Use the App to harass, endanger, or harm others
Distribute, sublicense, or commercially exploit the App or its outputs in ways inconsistent with this license

7. No Warranty: Caving Safety Disclaimer

SpeleoMap is a data-recording tool, not a safety device. Cave environments are inherently dangerous. The App does not provide navigation, emergency-egress guidance, route-finding, or any other life-safety function. Survey data produced by the App may be incomplete, inaccurate, or stale. You are solely responsible for your own safety, your route planning, your equipment, and your decisions in the cave.

The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

8. Limitation of Liability

To the maximum extent permitted by law, AFDC, its officers, members, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or use, arising out of or in connection with the App, the data it produces, AFDC's cave conservation activities, your reliance on any output, or your activities in caves or any other environment, even if AFDC has been advised of the possibility of such damages.

AFDC's total aggregate liability under these Terms shall not exceed the amount you paid for the subscription in the twelve months preceding the event giving rise to the claim.

9. Indemnification

You agree to indemnify and hold harmless AFDC and its officers, members, employees, and agents from any claim, demand, loss, or damage, including reasonable attorneys' fees, arising out of your use of the App, your violation of these Terms, or your violation of any third-party right. Your use of the App constitutes your acceptance of and agreement to the obligations set forth in this Section 9.

10. Termination

AFDC may suspend or terminate your access to the App at any time, with or without cause and with or without notice, including for violation of these Terms. No refunds will be issued in connection with any suspension or termination, whether initiated by AFDC for cause or otherwise. Upon termination, the license in Section 4 ends; provisions of these Terms that by their nature should survive (including Sections 3, 7, 8, 9, 10, and 12) will survive termination.

11. Changes to the Terms

AFDC may update these Terms from time to time. The "Effective Date" at the top reflects the most recent revision. Material changes will be brought to your attention through the App or by other reasonable means. Continued use of the App after changes become effective constitutes acceptance of the revised Terms.

12. Governing Law and Disputes

These Terms are governed by the laws of the State of Colorado, without regard to its conflict of laws principles. You and AFDC agree that any dispute arising under or related to these Terms will be brought exclusively in the state or federal courts located in Colorado, and you consent to personal jurisdiction in those courts.

13. Apple App Store Terms

SpeleoMap is distributed through the Apple App Store. The Apple Media Services Terms and Conditions and any standard Apple end-user license agreement apply in addition to these Terms. In the event of a conflict between these Terms and Apple's terms regarding App Store distribution or billing, Apple's terms control as to those subjects.
